Administration of Estates

Lasting Powers of Attorney

Managing your affairs in later life can become more difficult and it is wise to nominate someone whom you trust to look after your affairs, should the time come when you become mentally or physically incapacitated.

A Lasting Power of Attorney (LPA) (which replaces the Enduring Power of Attorney) enables you to choose who you would like to manage your property, financial and general affairs should you become unable to manage them yourself, and gives that person the measure of power that you define. Your choice of Attorney can be altered at any time, but comes into play either when you choose or when your mental health declines (subject to certain safeguards imposed by the Office of the Public Guardian).

The new LPAs can extend beyond dealing with your financial affairs to personal welfare matters and decisions, if you so wish. You will also be able to place restrictions on what exactly your Attorney can deal with, such as property or restricting medical decisions. But probably the most significant change is the requirement that LPAs must be registered with the Office of the Public Guardian before your Attorneys can act and this may take up to 5 months. Your Attorneys may have the power to decide on issues such as where you will live, your care and medical treatment. They may also give or refuse consent to the carrying out or continuation of medical treatment, according to your wishes, although they cannot act if you are still capable of making those decisions for yourself.

Living Wills

Living Wills, also known as Advance Directives, are usually concerned with medical discretion and they give you the freedom to define medical care issues that you feel strongly about. This means that in the unfortunate event of terminal illness, where you might be incapable of communicating your wishes, your Living Will would be able to state your preferences in cases such as turning the life support machine off.

Power of Attorney – Make sure your wishes are respected

The first thing to do, whenever possible is to make a Lasting Power of Attorney so as to ensure that your affairs are entrusted to the person or persons who you personally wish to appoint and so that you have the maximum input into the arrangements.

Dispute Resolution

A Power of Attorney is a means by which one person can legally authorise another to act for them at a time or in a place where they might not otherwise be able to act for themselves. This might be for a short term (e.g. during a holiday or for the duration of a stay in hospital), when a General Power might be appropriate.

It might be made specifically to operate a Trust when a Trustee Power would be required, or made in advance (perhaps before going into a nursing home) when the intention would be that the Power should last indefinitely even if the donor were to loose the mental capacity to manage their own affairs, in such circumstances a Lasting Power might be appropriate.

There are two different types of Lasting Powers, a property and affairs Lasting Power, which authorises another person to be responsible for your finances (access your bank account, sell your house etc) and a health and personal welfare one which covers your living arrangements, care needs, medical treatment etc. By using two different Lasting Powers you are able to nominate different people to carry out different tasks, one could be responsible for your finances another for your welfare. A Lasting Power of Attorney must be registered with the Office of the Public Guardian before it can be used. The donor of the power can register it whilst they have capacity or the Attorney may do so at any time.

The forms to apply for each of the Lasting Powers are lengthy and complex. We have specialist knowledge and experience and are ready to help you set up your Power of Attorney.

If you have not made provision for the appointment of an Attorney to look after your affairs then, in the event that you did become mentally incapable it would be necessary to make application to the Court of Protection for the appointment of a "Deputy" to manage your affairs. We have considerable experience of such Court of Protection work and would be pleased to help you if this becomes necessary. However we always recommend our clients to make a Lasting Power of Attorney whenever possible so that decisions can be made early and in line with the donor's wishes.
